1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the DigiRaffle website and web application (collectively, the “Service”), operated by DigiRaffle (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
DigiRaffle is a raffle and basket auction event management tool that allows organizers to digitally display winning ticket numbers so attendees can check results on their phones. The Service does not handle ticket sales, payment collection from attendees, or any financial transactions between organizers and event participants.
2. Eligibility
You must be at least 18 years of age to create an account and use the Service as an organizer. By creating an account, you represent and warrant that you are at least 18 years old and have the legal authority to enter into these Terms.
Event attendees may view published event results without creating an account and are not required to agree to these Terms to view winning ticket numbers.
3. Accounts
To create and manage events, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. We reserve the right to suspend or terminate accounts that contain inaccurate or misleading information.
4. The Service
Event Creation
You may create events and add baskets (including names, descriptions, and images) at no charge. Creating an event does not obligate you to publish it.
Publishing Events
To make winning ticket numbers publicly visible to attendees, you must publish your event. Publishing an event costs $9.99 per event, charged at the time of publishing. Once an event is published, the event details and baskets are locked and cannot be modified.
Winning Ticket Numbers
You may enter and edit winning ticket numbers before and after publishing. After an event is published, winning ticket numbers may be edited for up to 7 days. After the 7-day edit window closes, winning ticket numbers are permanently locked.
Public Visibility
When you publish an event, the event name, basket names, basket descriptions, basket images, and winning ticket numbers become publicly accessible to anyone with the event link. You are solely responsible for the content you publish through the Service.
5. Payments and Refunds
Event publishing fees are processed through Square, our third-party payment processor. By making a payment, you also agree to Square’s terms of service.
The $9.99 publishing fee is a one-time, per-event charge. There are no recurring subscription fees.
Because publishing immediately makes your event data publicly accessible, all publishing fees are non-refundable once the event has been published. If you experience a technical issue that prevents your event from being published correctly, please contact us at support@digi-raffle.com and we will work to resolve the issue.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any illegal activity, including but not limited to operating raffles or games of chance in violation of applicable local, state, or federal laws
- Post content that is defamatory, obscene, threatening, harassing, or that infringes on the rights of others
- Upload images or content that you do not have the right to use
- Attempt to gain unauthorized access to the Service, other users’ accounts, or any related systems or networks
- Interfere with or disrupt the Service or servers connected to the Service
- Use automated tools, bots, or scrapers to access the Service without our prior written consent
- Include sensitive personal information (such as Social Security numbers, financial account numbers, or health information) in event or basket details
We reserve the right to remove any content and suspend or terminate any account that violates these Terms, at our sole discretion and without prior notice.
7. Raffle Compliance
You are solely responsible for ensuring that your raffle, basket auction, or other event complies with all applicable laws and regulations in your jurisdiction. Raffle and game-of-chance laws vary significantly by state, county, and municipality. DigiRaffle does not provide legal advice and makes no representations about the legality of any particular raffle or event.
DigiRaffle is a tool for displaying winning ticket numbers — it does not conduct, manage, or oversee the drawing of winners, the sale of tickets, or the distribution of prizes.
8. Intellectual Property
The Service, including its design, features, code, branding, and documentation, is owned by DigiRaffle and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
You retain ownership of the content you upload to the Service (such as basket images and descriptions). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of operating and providing the Service.
9. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by applicable law, DigiRaffle and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
In no event shall our total liability to you for all claims arising out of or related to the Service exceed the amount you have paid to us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless DigiRaffle and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation, including raffle and game-of-chance laws.
12. Account Termination
You may delete your account at any time through your account settings or by contacting us at support@digi-raffle.com. Upon deletion, your account data will be removed in accordance with our Privacy Policy.
We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. If we terminate your account due to a violation of these Terms, you will not be entitled to a refund of any fees paid.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last Updated” date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New Jersey.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DigiRaffle regarding your use of the Service and supersede any prior agreements or understandings.
